加拿大新商標(biāo)法6月17日起生效，現(xiàn)在續(xù)展可節(jié)省官費(fèi)！

自2014年加拿大議會(huì)通過(guò)修訂商標(biāo)法的決議，時(shí)隔五年，加拿大新商標(biāo)法終于塵埃落定，并將自2019年6月17日起生效。

加拿大《商標(biāo)法》

2019年6月17日，期待已久的加拿大《商標(biāo)法》修法將開(kāi)始實(shí)施。本次修法覆蓋多個(gè)領(lǐng)域，包括注冊(cè)續(xù)展以及必須將商品跟服務(wù)項(xiàng)目按照尼斯分類系統(tǒng)（總共45個(gè)類別）分類。

關(guān)于續(xù)展，網(wǎng)上續(xù)展官費(fèi)將從目前的350加元（無(wú)論多少類商品和服務(wù)項(xiàng)目）上升到第一類400加元，之后每增加一類125加元。

因此新的官費(fèi)框架會(huì)較大影響覆蓋多類別的加拿大商標(biāo)注冊(cè)。

On June 17, 2019, Canada’s much anticipated amendments to the Trademarks Act will come into force.  These changes extend to various areas, including the renewal of registrations and the requirement for goods and services be classified according to the Nice classification system that contains 45 classes of goods and services.

There will be an increase of government renewal fees from the current fee of CAD$350 (if renewal is requested online) regardless of the number of classes of goods and services. Under the new regime, the renewal fee for a trademark registration will be CAD$400 for the first class of goods/services and CAD$125 for each additional class.

Registrations covering multiple classes will therefore be seriously impacted by the new fee structure.

商標(biāo)續(xù)展

加拿大目前允許任何當(dāng)前存在的商標(biāo)注冊(cè)在2019年6月17日之前續(xù)展。

* 因此，加拿大商標(biāo)注冊(cè)人可以通過(guò)在2019年6月17日前完成續(xù)展來(lái)節(jié)約官費(fèi)。續(xù)展可以網(wǎng)上申請(qǐng)，續(xù)展證書可以電子件形式頒發(fā)，可在網(wǎng)上申請(qǐng)一個(gè)工作日內(nèi)獲得。

Canada’s current trademark regime allows any existing trademark registrations to be renewed prior to June 17, 2019.

* Owners of Canadian registered trademarks therefore can potentially reduce government renewal fees if renewals are requested and processed before June 17, 2019.  Renewals can be requested online and certificates of renewal may be issued electronically within one business day upon receipt of an online renewal request.

*2019年6月17日后，續(xù)展只能在注冊(cè)到期前的6個(gè)月或者到期后的六個(gè)月內(nèi)請(qǐng)求。

*After June 17, 2019, a renewal request can only be made between 6 months before and 6 months after the registration expiry.

Our Recommendation：

Renew your registered Canadian marks that are active before June 17, 2019 to take advantage of the flat government renewal fee.  As a renewal request must be processed by the Trademarks Office before June 17, 2019, requesting renewal should be initiated sufficiently in advance of such date.
